Welcome to Maclane’s Automotive, a trusted auto repair shop serving Pennsylvania. By engaging our automotive repair services or using our website, you agree to these Terms of Service. These Terms govern the provision of vehicle repair, maintenance, and related services, including interactions through our website for scheduling, communication, or other functionalities. Please read them carefully.

1. Services Provided

Maclane’s Automotive offers professional auto repair services, including but not limited to brake repair, oil changes, tire services, engine diagnostics, transmission repair, and general vehicle maintenance. All services are performed by certified technicians in accordance with Pennsylvania state regulations and industry standards. Website functionalities, such as online appointment scheduling, customer communications (e.g., email or text reminders), and service inquiries, are provided “as is” and “as available” without warranties beyond those explicitly stated.

2. Service Estimates and Authorization

Before performing any auto repair or maintenance, including services booked via our website, we will provide a written or verbal estimate of the costs, including labor and parts. You must authorize all services in writing, verbally, or through our website before work begins. Additional repairs discovered during service will be communicated to you, and your approval is required before proceeding. We are not responsible for delays due to parts availability, unforeseen repair complexities, or issues with website functionality.

3. Payment Terms

Full payment is due upon completion of services unless otherwise agreed. We accept cash, credit/debit cards, and other approved payment methods, including payments processed via our website. A late fee of 1.5% per month may be applied to unpaid balances after 30 days. You are responsible for any collection costs, including reasonable attorney fees, if payment is not made as agreed. By providing payment information through our website, you authorize Maclane’s Automotive to submit transactions to your issuing bank for settlement and agree to contact us to cancel recurring charges before the next billing cycle.

4. Warranties

Maclane’s Automotive provides a limited warranty on parts and labor for a period of 12 months or 12,000 miles, whichever comes first, unless otherwise specified. This warranty covers defects in workmanship and parts supplied by us, subject to normal use and maintenance. Warranties do not cover damage from misuse, accidents, or unauthorized repairs. All warranty claims must be presented at our Pennsylvania facility. Some parts may carry manufacturer warranties, which we will honor per the manufacturer’s terms. Website functionalities are provided without warranties of merchantability, fitness for a particular purpose, or freedom from defects, and Maclane’s Automotive is not liable for delays, inaccuracies, or issues arising from their use.

5. Customer Responsibilities

You agree to:

  • Provide accurate information about your vehicle’s condition and any known issues, including when using our website.

  • Retrieve your vehicle promptly upon service completion.

  • Maintain the confidentiality of account credentials used with our website and notify us immediately of unauthorized use.

  • Ensure content submitted via our website (e.g., inquiries, feedback) does not violate laws, infringe third-party rights, or constitute spam, threatening, or illegal material.

  • Provide accurate instructions for any third-party systems (e.g., software or databases) interfaced with our website, bearing responsibility for any incomplete or faulty information.

Vehicles left at our facility for more than 30 days after notification of completion may be subject to storage fees of $25 per day, and we may pursue legal action to recover the vehicle as per Pennsylvania law.

6. Liability and Risk

Maclane’s Automotive is not liable for loss or damage to your vehicle or personal property left in the vehicle, except in cases of our gross negligence or willful misconduct. We recommend removing valuables from your vehicle before service. We are not responsible for incidental or consequential damages arising from our services or website functionalities, to the extent permitted by Pennsylvania law. Maclane’s Automotive is not liable for:

  • Indirect, incidental, or consequential damages from website functionalities.

  • Loss of data, profits, or opportunities due to website errors, security breaches, or service interruptions.

  • Issues arising from your use of website functionalities outside the United States, where you are responsible for compliance with local laws.

Our total liability is limited to the fees paid to Maclane’s Automotive for services in the 12 months prior to the claim. No claims related to website functionalities may be filed more than 12 months after the event giving rise to the claim.

7. Compliance with Pennsylvania and Federal Law

All services, including those facilitated by our website, comply with the Pennsylvania Automotive Industry Trade Practices (73 P.S. § 1961 et seq.) and other applicable state and federal regulations, including CAN-SPAM and TCPA for communications. You have the right to a written estimate and to authorize repairs. Disputes regarding service quality or charges may be addressed through the Pennsylvania Bureau of Consumer Protection. You are responsible for ensuring your use of our website complies with all applicable laws, including data privacy and telecommunications regulations.

8. Third-Party Account Access

Our website may require you to provide access to third-party accounts or login information (e.g., for scheduling or communication services). You represent that you have all necessary contractual and legal rights to grant such access to Maclane’s Automotive. You agree to comply with all agreements governing these third-party accounts.

9. Termination of Services

We reserve the right to refuse service or terminate access to our website for any customer who violates these Terms, provides false information, fails to make timely payments, or engages in fraudulent or unlawful activities. If services or website access are terminated, you remain responsible for costs incurred up to that point. We may suspend or terminate website access for breaches, including non-payment or violation of our Privacy Policy or Terms of Use, and may delete data collected via the website if the breach is not cured within 30 days.

10. Dispute Resolution

Any disputes arising from these Terms, our services, or our website will be resolved through negotiation in good faith. If unresolved, disputes will be subject to mediation or arbitration in Pennsylvania, as permitted by law. You agree that any legal action must be filed in a court of competent jurisdiction in Chester County, Pennsylvania, within one year of the claim arising, or it will be forever barred. You waive the right to a jury trial.

11. Modifications to Terms

We may update these Terms periodically to reflect changes in our practices, website functionalities, or legal requirements. The most current version will be posted on our website or available at our shop. Continued use of our services or website after changes constitutes acceptance of the updated Terms.
